Personal Data Protection

This information on the processing of personal data by Hortus Media Sp. z o.o. applies to data received:

  • via electronic forms,
  • under customer contracts (contact details only), and
  • by representatives of Hortus Media Sp. z o.o. in the scope of purchasing, sales or marketing activities (e.g. as part of business meetings or correspondence, as part of conferences or other events, tenders, negotiations, etc.).

Collection of personal data

Hortus Media Sp. z o.o. may receive contact details directly from the data subject (e.g., via electronic forms or during conferences) or through other persons (e.g., from an employer, another employee, or another entity with which the data subject regularly cooperates).

In the case of direct contact, you have full control over the scope of data shared with Hortus Media Sp. z o.o.

If data is provided by another person, only basic contact details related to professional activity are usually collected, including: first name, last name, e-mail address, telephone number, position or function, company and, if applicable, other data resulting from the contract or order in connection with which the personal data of the contact person is provided.

Legal basis, processing purposes, processing period

Personal data is processed by Hortus Media Sp. z o.o. for the purposes specified below.
I.
PURPOSE: performance of a contract or order, LEGAL BASIS: Article 6, paragraph 1, point b) of the GDPR
PROCESSING PERIOD: period of performance of obligations and the limitation period for claims arising from the provisions

If a contract or order is concluded between you and Hortus Media Sp. z o.o., the data provided by you will be processed for the purpose of fulfilling such contract or order and its settlement.

In the case of electronic forms used to download/order a file (e.g. Jagodnik archive, e-shop purchases), the data provided will be processed for the purpose of delivering the ordered file and for the purpose of contacts related to it and possible settlements.

In the case of electronic forms enabling registration for a conference, training, or other event organized by Hortus Media Sp. z o.o., the data provided will be processed for the purpose of organizing the event and for contacting you in connection with that event, as well as for any billing purposes.

II.
PURPOSE: business contacts, LEGAL BASIS: Article 6(1)(f) of the GDPR
PROCESSING PERIOD: until the date the objection submitted pursuant to Article 21 of the GDPR is upheld

Contact details entered on an electronic form, provided as part of a contract or order, or otherwise provided may be processed by Hortus Media Sp. z o.o. for the purpose of business contact.

Representatives of Hortus Media Sp. z o.o. may contact you to present an offer, invite you to a meeting or event organized by Hortus Media Sp. z o.o., or as part of other marketing activities. You may occasionally receive information regarding Hortus Media Sp. z o.o.’s products, services, or activities, as well as other information related to Hortus Media Sp. z o.o.’s business activities.

In such a case, the processing of your data will be undertaken in order to pursue the legitimate interest of the controller, which is the marketing and sale of products and services as well as building and strengthening business relationships.

You have the right to object to such processing of personal data as described in the RIGHTS section.

III.
PURPOSE: newsletter, LEGAL BASIS: Article 6, paragraph 1, point a) of the GDPR
PROCESSING PERIOD: until you unsubscribe from the newsletter (withdrawal of consent)

If you agree to receive a newsletter from Hortus Media Sp. z o.o. (jagodnik.pl, warzywpolowe.pl), your email address will be used to send newsletters. The newsletter will be sent to you at a frequency selected by the marketing department to ensure you have access to up-to-date information on the latest industry news.

We would like to point out that, regardless of your consent to the newsletter, the administrators may have the basis to process your data for the purpose of business contacts within the legitimate interest of the administrator (in accordance with point II).

IV.
PURPOSE: response to inquiry, LEGAL BASIS: Article 6, paragraph 1, point a) of the GDPR
PROCESSING PERIOD: until you withdraw your consent

By completing the contact form or submitting an inquiry in another way (e.g., email, telephone, social media), you consent to being contacted regarding your request or inquiry. To withdraw your consent, please use the contact details provided in the “CONTACT DETAILS FOR PERSONAL DATA” section. This consent may be withdrawn at any time, but its withdrawal does not affect the lawfulness of processing prior to withdrawal. Furthermore, withdrawal of consent will result in the lack of a response.

V.
PURPOSE: event organization and promotion, LEGAL BASIS: Article 6(1)(f) of the GDPR
PROCESSING PERIOD: the period of performance of obligations and the limitation period for claims arising from the regulations or until the date of upholding an objection filed under Article 21 of the GDPR

If you register for a conference, training session, or other event organized by Hortus Media Sp. z o.o., your data may be shared with other participants, speakers, hotels, and other entities associated with the event. Information about speakers may also be made publicly available on the website, in the event app, and in promotional and conference materials.

In such a case, the processing of your data will be undertaken in order to pursue the legitimate interest of the controller, which is the execution of concluded contracts, fulfillment of obligations and promotion through the organization of events.

You have the right to object to such processing of your personal data as described in the RIGHTS section.

PURPOSE: performance of a contract or order between Hortus Media Sp. z o.o. and another entity. LEGAL BASIS: Article 6, paragraph 1, point f) of the GDPR.
PROCESSING PERIOD: the period of performance of obligations and the limitation period for claims arising from the provisions, or until the date of upholding an objection filed under Article 21 of the GDPR.

If you are designated as a contact person by your employer or another entity, your data may be processed for the purpose of performing and settling the contract (or order) concluded between Hortus Media Sp. z o.o. and your employer or such other entity. In such a case, data processing will include ongoing contacts related to the performance of such contract, preparing and archiving documentation on the performance of the contract, and pursuing or defending against claims of the other party.

In such a case, the processing of your data will be undertaken in order to pursue the legitimate interest of the controller, which is the protection of rights, the execution of concluded contracts and obtaining due remuneration in this respect.

You have the right to object to such processing of personal data as described in the RIGHTS section.

VII.
PURPOSE: compliance with the legal obligation to prepare and store documentation. LEGAL BASIS: Article 6, paragraph 1, point c) of the GDPR.
PROCESSING PERIOD: the period for storing invoices, accounting records, and documents confirming the conclusion and performance of the contract, resulting from the national regulations of the controller.

When performing a contract, order, or other service on your behalf, we will also process personal data contained in invoices, accounting records, or other documentation confirming the conclusion and performance of the contract to prepare and store documents in accordance with applicable law. This applies to situations where you are a party to the contract or order, as well as situations where your employer or an entity with which you cooperate is a party to the contract or order, or where any service has been provided to you (e.g., a hotel reservation).

VIII.
PURPOSE: confirming the performance of obligations and pursuing or defending against claims. LEGAL BASIS: Article 6, paragraph 1, point f) of the GDPR.
PROCESSING PERIOD: the period of performance of obligations and the limitation period for claims arising from the provisions of law.

Data entered into an electronic form, provided as part of a contract or order, or otherwise made available to Hortus Media Sp. z o.o. may be processed for the purpose of archiving information or documents confirming the performance of Hortus Media Sp. z o.o.’s obligations and for the purpose of pursuing potential claims or defending against claims against Hortus Media Sp. z o.o.. This applies to situations where you are a party to the contract or order, as well as situations where your employer or an entity with which you cooperate is a party to the contract or order, and situations where Hortus Media Sp. z o.o. was obligated on any basis to perform a service on your behalf or exercise your rights.

In such a case, data processing will be undertaken in order to pursue the legitimate interest of the controller, which is the protection of rights, confirmation of the performance of obligations and obtaining due remuneration for this.

You have the right to object to such processing of personal data as described in the RIGHTS section.

Failure to provide personal data

In the case of electronic forms – providing data is voluntary, however, failure to provide data indicated as obligatory (required) results in the inability to send the form and, consequently, depending on the type of form, the inability to download the file, participate in an event or subscribe to the newsletter.

In the case of data collected by representatives of Hortus Media Sp. z o.o. for purchasing, sales, or marketing activities, providing data is entirely voluntary and failure to provide it may result in the inability to contact you in the future.

In the case of data of persons who are parties to a contract/order concluded with Hortus Media Sp. z o.o. – providing the data necessary to perform the contract and comply with legal obligations is a condition for concluding and performing the contract.

Unsubscribing from the newsletter

If you consent to receiving the newsletter, consent is voluntary and may be withdrawn at any time. To do so, please follow the instructions in the newsletter you receive or use the contact details provided in the “CONTACT DETAILS FOR MATTERS RELATING TO PERSONAL DATA” section. Withdrawing consent does not affect the lawfulness of data processing prior to withdrawal.

If you unsubscribe from the newsletter but do not object to business contacts, we may still have a basis to contact you for this purpose (point II. in the section LEGAL BASIS, PURPOSES OF PROCESSING, PROCESSING PERIOD). To object to such contacts, please use the contact details provided in the section “CONTACT DETAILS FOR MATTERS RELATING TO PERSONAL DATA.”

Permisions

In accordance with the provisions of the GDPR, you have the right to:

  1. access to data;
  2. rectification of data;
  3. deletion of data;
  4. restrictions on data processing;
  5. data transfer;
  6. objection (when the basis for processing is the legitimate interest of the controller);
  7. withdrawal of consent (when the basis for processing is consent).

The exercise of these rights depends on the conditions specified in the GDPR. If your request is denied, you will receive a response
with the reasons for the denial.

In order to exercise your rights, please contact us in accordance with the information provided in the section “CONTACT DETAILS IN MATTERS RELATING TO PERSONAL DATA”.

We draw your attention to the fact that:

  • the right to delete data and the right to request the restriction of their processing are only available in the cases listed in the provisions of the GDPR;
  • the right to data portability applies only if the legal basis for processing is consent or performance of a contract;
  • the controller may refuse to delete your data despite such a request, provided that one of the exceptions listed in the GDPR applies, e.g. when data processing is necessary to comply with a legal obligation or to establish, pursue or defend legal claims;
  • in some cases, the controller may refuse to take into account your objection to data processing based on the controller’s legitimate interest, when there are valid legitimate grounds for data processing that override your interests, rights and freedoms or there are grounds for establishing, pursuing or defending claims – such right is not available to the controller when the data are processed for direct marketing purposes (e.g. commercial contacts).

From 25 May 2018, you have the right to lodge a complaint with the competent supervisory authority, which in Poland is the President of the Personal Data Protection Office.
